There was no proper basis to reopen the judgment or admit the defendant's new affidavits because the issues on share reallocation had been litigated, the plaintiff had presented evidence and its witness was available for cross-examination (which did not occur on that point), and a prior judicial finding that the 2006 allocation was invalid made reconsideration inappropriate; accordingly the original judgment finding oppressive conduct stands and liquidation is ordered.
