The interim injunction was discharged because damages were an adequate remedy (defendant could pay any differential), the balance of convenience favoured the defendant entitled to divest under cl 5.12 given the plaintiff's conviction, and the plaintiff's without‑notice application was procedurally deficient and omitted critical documents.
