Leave to appeal was granted because there exists an arguable question of law whether an increased risk of a consequence (ORN) is legally equivalent to that consequence being an 'ordinary consequence of treatment' under s32(1); the issue is one of statutory construction not merely of fact and therefore suitable for appeal on a question of law.
