An interim injunction was justified because there was a serious question to be tried as to breach of s 176, damages may be an inadequate remedy given the alleged substantial undervalue of the sale and the potential for significant business loss, and the balance of convenience favoured temporary preservation of the status quo especially as the bank did not oppose the application; accordingly a limited one‑week injunction was appropriate.
