O’NEILL v ATTORNEY-GENERAL OF NZ [2018] NZHC 1073

Associate Judge Christiansen correctly struck out the proceeding because the detention was lawful despite errors in the warrants, the pleaded false imprisonment claim was not reasonably arguable on the facts, the wider factual allegations lacked any identified legal basis and the statement of claim failed to inform defendants of the legal causes of action such that the pleading was abusive of process; the strike-out was therefore affirmed on review.
