The Court held there was no jurisdiction to award the applicant costs outside the creditors' approved Part 14 compromise because the applicant's costs constituted a contingent debt available for voting, he failed to place a valuation before creditors or seek timely relief under s 232(3), and the creditors lawfully resolved to compromise the company's liabilities; accordingly the costs claim was bound by the compromise and the application for costs was dismissed.
