A stay of enforcement pending the appeal was granted because, on balance, the evidence of monthly $100,000 payments from ManukaMed into the defendant's solicitors' trust account, the solicitors' undertaking to pay sums to MIL if the appeal fails, and additional proposed asset realizations (sale of house or ManukaMed stock) constituted sufficient assurance of repayment to avoid a substantial miscarriage of justice, subject to specified conditions and leave to return if conditions are not met.
