The originating application, supported by detailed affidavits (notably Peat and Cairns) and the Commissioner's letter of 8 March 2021, provided sufficient particularity to communicate the Commissioner's case; because the court should only order a statement of claim when necessary and proportionate and ordering one here would not add materially and would risk delay, the application to compel a statement of claim was dismissed.
