The Justices of the Supreme Court were not properly joined and were struck out; costs were assessed by reference to the High Court Rules classification (category one, band A) but the court ordered only the actual costs incurred ($770) because that amount was less than the scale calculation.

Z Energy failed to establish that each individual step required more than normal time to justify band C and did not prove Svitzer acted unreasonably in a way that materially contributed to the time or expense of the proceedings to justify an uplift; therefore costs were ordered to Z Energy on a 2B basis and no increased costs awarded.

Because the stay and directions were unopposed and the correctness of parties and jurisdictional issues required resolution before any substantive fixture, the Court granted a stay, ordered correction/substitution and joinder of parties, and issued specific timetabling directions to determine the application for review before the substantive hearing.
