The Court was satisfied that the statutory requirements of s 309(1)(b) were met: ASB's debt was fully paid, Terminus's debt was satisfied by an agreed proposal accepted and amended as a proof of debt, and the Assignee's fees and costs were covered by funds held by the Assignee; accordingly the adjudications were annulled.
