The Court found there was insufficient evidence of any underlying physical injury caused by the cyclogyl instillation; the appellant's immediate and ongoing symptoms were attributable to expected pharmacological effects, possible pre-existing migraine or other non-physical mechanisms, and not to a treatment-caused physical injury, therefore the Corporation's decision to decline cover for a treatment injury was correct and the appeal is dismissed.
