The plaintiff succeeded and was entitled to costs; indemnity costs were not awarded, but a 50% uplift on scale 2B costs was justified because the defendant breached her duties as a director and failed to repay on demand despite ultimately returning funds; costs were fixed at $22,227.00 plus disbursements as fixed by the Registrar.

Pursuant to the Court's discretion under s 24A(2)(e) of the Construction Contracts Act 2002, interim relief was appropriate on a Pickwick basis and Spotless was ordered to lift its suspension upon FCC depositing $2,067,715.86 (excluding GST) with the agreed stakeholder to be held on interest-bearing deposit and disbursed in accordance with further order of the Court; leave to apply reserved.

Because the first defendant through his solicitor indicated he would not oppose and the court was satisfied the proposed clause 1(a) could bind him while allowing him to continue his business, the court granted the interim injunction in terms of the Notice of Motion clause 1(a) and set a review hearing by telephone conference on 31 July 2009.
