The High Court held the arbitrator was entitled to revisit and reassess costs following remittal and to exercise his discretion in fixing costs having regard to conduct, complexity and overall results, and therefore his awards were largely upheld; however it was an error to require Gladvale to pay half of the arbitrator's initial fees (NZD 15,672.58) given both parties had measures of success, so that direction was set aside while the remainder of the costs awards were confirmed.
