Respondent was entitled to category 2B scale costs for the three interlocutory applications; the Court rejected the Commissioner's proposed exclusions for Application Two (hearing had occurred) and refused increases for Applications Two and Four as not justified, but awarded a modest uplift of $3,000 for Application Three because the Commissioner pursued serious unpleaded allegations of underhand/fraudulent conduct that wasted time and were unreasonable; total award $20,490.02.
