The Supreme Court dismissed the leave application because the Court of Appeal correctly declined the fresh evidence as not fresh or cogent, the allegations of police impropriety and unlawful search were thoroughly considered and rejected, the circumstantial and direct evidence was strong and the applicant failed to show any real risk of a substantial miscarriage of justice under s 13(2)(b).
