The respondent was an eligible offender and the court, applying the three‑step test, found a pervasive pattern of vindictive sexual offending, that the respondent met all s 107IAA criteria (intense vindictive drive, proclivity for rape, limited self‑regulation, and lack of acceptance/responsibility), and that there is a high risk of future relevant sexual offending; accordingly an Extended Supervision Order was necessary for community safety and the minimum appropriate term was five years.
