    BARKER v BARKER [2017] NZHC 2348

    Citation
    [2017] NZHC 2348
    Court
    High Court

The Court held that general bank records of Mr Woods showing payments to Gwenda were not relevant, but ordered Wendy to produce records of cash withdrawals from Mr Woods' accounts and any deposits from his accounts to her accounts from the date he executed a power of attorney in her favour, together with her own bank statements showing deposits within seven days of any cash withdrawal of $200 or more from Mr Woods' accounts, on the basis that those records may show use of the power of attorney to obtain funds used on the trust property and may affect executor/trustee issues.
