Although the plaintiff succeeded in quashing the District Court decisions and was prima facie entitled to costs, the Court reduced the award because the second defendant acted reasonably in defending the matter given the tangled background, and a practical compromise during litigation produced the final outcome; accordingly a modest costs award of $4,000 inclusive of disbursements was appropriate.
