The Court accepted the Clinical Advisory Panel opinion and treating records over the appellant's consultant: the evidence showed symptomatic medial epicondylitis/tendinosis predating the relevant accident, the ultrasound finding was ambiguous between tendinosis and tear, and the injury was more likely degenerative or an aggravation of a pre-existing condition rather than a new traumatic tear; therefore ACC correctly declined cover for the proposed surgery.
