The Supreme Court allowed the appeal, holding that Fogarty J's factual assessment of culpability was open on the evidence and that three years was an appropriate starting point but that the appellant's extreme and recent personal tragedy warranted a modest reduction of six months; the three year sentence was quashed and substituted with two years six months imprisonment.
