The Court held the trial judge correctly admitted evidence of the appellant's prior convictions (charges 1, 3, 6 and 7) because they were relevant and probative of consent, duress and reasonable belief and their probative value outweighed any unfair prejudice under s 8; the appellant did not establish the exceptional circumstances necessary under s 49(2) to permit relitigation of those convictions or to remove their conclusive effect.
