The Court declined to make a costs order at this stage and deferred determination of costs until after resolution of the substantive proceedings (including related Environment Court PWA objection proceedings), because although the preliminary questions were substantive for those issues, awarding costs now would be inefficient, might require revisiting, and would prevent consideration of matters relevant to a final costs assessment (for example offers to settle).
