The Court held that s300 of the Accident Insurance Act 1998 and the 1999 regulations require the premium to be calculated by reference to the prior financial year's income (1998/99) and prorated for the nine-month period, leaving no discretion to use income actually earned in the premium period; therefore the respondent's calculation of $1,321.70 was correct and the appeal was dismissed.
