On the balance of probabilities the Judge found the appellant's progressive knee condition was caused by the 12 January 2008 injury; the primary purpose of the proposed total knee replacement was to treat the sequelae of the large medial meniscal tear and associated secondary cartilage damage, therefore ACC cover applies and the Corporation's decline was quashed.
