The Judge did not err: given the violent group assault in a prison and an assault on a prison officer, prioritising deterrence and denunciation was a legitimate exercise of sentencing discretion under ss 7 and 8; the Judge's choice of imprisonment over home detention fell within the available range and the discretionary margin and was not plainly wrong, particularly as home detention was inappropriate given the nature of the offence and the appellant's concurrent custody status.
