The application for non-party discovery is dismissed: comparative credentialing records of other practitioners are not sufficiently relevant to the plaintiff's tort claim against the defendants; and disclosure of evaluative material (including identities of sources) would likely harm the free flow of confidential information essential to private hospital credentialing and that public interest outweighs the interest in disclosure under s69 Evidence Act 2006.
