The Privacy Commissioner is not a direct party to the Tribunal decision but may continue to participate in the appeal by virtue of statutory rights of intervention under s86 of the Privacy Act; accordingly her strike-out application to be removed from the appeal was resolved by her agreeing to continue involvement as an intervener, and her strike-out application in the judicial review was withdrawn because no arguable cause of action against her was established at that stage and further particulars may be sought.
