The Tribunal correctly applied the Privacy Act: the Police conceded prima facie breach under Privacy Principle 11 but failed to discharge the onus under s87 to show either exception 11(a) or 11(e)(i) applied because there were no reasonable grounds linking the disclosure to the purposes for which information was obtained nor that disclosure that evening was necessary to avoid prejudice to the maintenance of the law.
