Duties imposed on statutory managers by the Corporations (Investigation and Management) Act 1989 are public duties; the wording of s41 (to 'have regard to') and the Act's purpose and supervisory scheme demonstrate Parliament did not intend to create a private right of action for breach of statutory duty, therefore the plaintiffs' cause of action is legally untenable and the statement of claim is struck out.
