On the balance of probabilities the preponderance of contemporaneous and specialist medical evidence (orthopaedic, occupational medicine, neurology) establishes there was no physical injury or structural damage to the cervical spine consequent on the workplace change; migraine and muscle spasm were physiological or symptomatic not evidence of a physical sprain; because s26(1)(b) physical injury is not established the s30 work-related gradual process claim fails and the appeal is dismissed.
