The applicant is entitled to access documents listed in r 8(3) as of right and, on balancing the r 12 factors (including open justice and privacy) and having regard to the inability to notify the defendant after reasonable inquiries, the Court grants permission under the Rules to inspect the entire court file but imposes conditions limiting publication and copying to protect privacy and confidentiality.

The High Court held the Part 14 compromises were valid and within the scope of the Companies Act 1993; the Support Deed did not prohibit the negotiations or formal agreement reached nor was it breached in a way that invalidated the compromises; notices and creditor class composition complied with the statute and practice; no material irregularity or unfair prejudice to Bank of Tokyo was established; accordingly Bank of Tokyo's claims were dismissed and it is bound by the compromises.

Because the application was properly supported, considered under the High Court Rules as incorporated into the District Court Rules, and had been made on notice to the respondent, the court had jurisdiction and discretion to appoint Michael (Mike) Felton as litigation guardian for Megan Felton and did so.
