On the balance of probabilities the cash was acquired from significant criminal activity because it was found packaged with a handwritten tick list consistent with drug sales, bank deposits and the cash amounts were consistent with sale of cannabis, the respondent had no declared income for an extended period and offered no credible corroboration for lawful sources; accordingly the cash is tainted property and a profit forfeiture order vesting $32,640 in the Crown was made.
