MITCHELL v R [2023] NZCA 593
- Citation
- [2023] NZCA 593
- Court
- Court of Appeal
The Court held the search warrant issues and the need for a second warrant were properly addressed during trial and, even if procedural impropriety occurred, it was a minor, remediable error; exclusion of the evidence would be disproportionate. Strategic choices made by defence counsel were reasonable on the evidence and did not amount to ineffective assistance that could have affected the outcome. Therefore the convictions were safe and the appeal was dismissed.
