The judge exercised discretion and concluded costs should lie where they fall because the applicants were seeking relief that interfered with respondents' property rights, the respondents were not solely responsible for the need for proceedings, and both sides bore responsibility for the further hearing and delays; therefore neither side was entitled to costs against the other.
