Because the co‑trustee neglected to appoint a replacement and failed to respond to communications, the applicant satisfied the requirements of s46 Trustee Act 1956 and was entitled to be discharged; the Court therefore appointed the Public Trustee as replacement (subject to conditions) and awarded costs to the applicant.

After considering seven years of dispute, failed reconciliation efforts, reports of the Public Trustee and the deep, entrenched distrust between the two factions, the Court concluded that reconciliation was unlikely and that, as a last resort, it is just and equitable to wind up the Trust Board and divide the trust assets; however formal liquidation was adjourned to allow compliance with Companies Act formalities and appointment consents, and interim orders for use and management were made.
