The statutory requirements of s13 were established and, on balance of factors under s37, adjudication was not refused because the debtor's asserted grounds for halting had passed or were unsubstantiated, there was risk of dissipation of assets, and public interest and the benefits of Official Assignee investigation favoured adjudication; accordingly the Court adjudicated the debtor bankrupt and ordered standard costs.
