The High Court held the BSA majority was plainly wrong on identification: the broadcast identified the appellant's son beyond family and close friends given the cumulative details and context; the son had a reasonable expectation of privacy in the disclosed matters (including false allegations obtained through a private family connection); the disclosure was highly offensive to an objective reasonable person; the privacy complaint was therefore justified and compensation of NZD 4,000 was awarded, with suppression of the complainant's name.
