The Court found the appellant suffered a single diagnosed mental injury (PTSD) caused by a series of sexual abuse events; because the injury arose prior to 1 April 2002 s.337(2) preserves Independence Allowance entitlement and the later events merely aggravated the pre‑existing injury rather than creating a new injury for Lump Sum, the assessed 22% WPI is payable only as an Independence Allowance; appeal dismissed.
