The High Court held the Crown process challenges were precluded by the comity/non-interference principle in light of the proximity of proposed settlement legislation; alternatively, on the merits the Crown did not act unlawfully—the Red Book is a general guide, no clear legitimate expectation to pause ratification was established, register differences were not materially fatal to the ratification, the Ministers reasonably accepted the ratification outcomes, and the Waitangi Tribunal's refusal of urgency was not irrational or legally flawed.
