Most of the information requested in the draft statutory declaration was reasonably required under s72; the appellant unreasonably failed to provide information related to his entitlement; consequently the Corporation's suspension of weekly compensation was lawful and the appeal must be dismissed.

The court held ACC's information requests were relevant and reasonable to assessing the appellant's past and ongoing entitlement and that the appellant's invocation of the privilege against self-incrimination did not make his refusal reasonable for the purposes of s117(3)(a); consequently ACC was entitled to decline/suspend entitlements during the period of unreasonable non-compliance.

The court held that the respondent lawfully required relevant confirmation of the appellant's farming activities and income under s.64; the appellant's refusal/unreasonable failure to provide that information justified cessation of weekly compensation under s.73; and the hearing was 'commenced' within three months for s.90(9) purposes by the arrangement of a hearing date, so the deemed determination argument failed. Accordingly the cancellation decision of 23 March 1994 was upheld.
