The original joinder of the fourth defendant was unreasonable because evidence supporting an express retainer was sparse and the Limitation Act barred claims predating 27 June 2007; accordingly the plaintiffs were ordered to pay the fourth defendant's costs fixed at $73,639.69 and the $20,000 security plus interest was to be released immediately with the balance payable within 14 days.
