The respondent had no statutory basis to suspend the appellant's Independence Allowance under Section 117 without first obtaining a reassessment under Clause 61 (via the required medical certificate) or properly revising the original decision under Section 390; suspension without following the reassessment or revision procedures was ultra vires and therefore quashed.
