On the balance of probabilities the appellant's lumbar pathology was caused by a work related gradual process and cumulative occupational exposure together with discrete workplace injuries; those combined factors were not wholly or substantially the result of ageing or genetic predisposition. The medical evidence of Dr Black and Dr Nicholson, coupled with the appellant's 30-year history of heavy lifting, driving with jarring and significant workplace incidents, established that employment was a substantial cause of his condition.
