Because the objector elected not to participate, provided no particulars or evidence, and had ample opportunity to be heard, nothing altered the conclusions of the recalled judgment; the Court reissued the judgment approving the scheme subject to the previously identified modification.

Revocation of the suppression order was appropriate because the order had been made by the Court without Crown or victim input, the victim does not support suppression, the respondent did not oppose revocation, and prior publication of the respondent's name undermined the purpose of the suppression; the Court accordingly revoked the order and recalled and reissued its earlier judgment with identifying details removed while maintaining statutory protections for the complainant.

The earlier judgment was based on a misunderstanding of the basis of the respondents' application; accordingly the correct course was to recall and reissue the judgment with specified paragraphs deleted and to allow the application under r 7.49(5), together with an apology for the unjustified criticism of counsel.
