The judge reduced the 2015 nine year starting point to eight years to reflect uncertainty about actual knowledge and a finding of recklessness, found high culpability, allowed an 18 month personal mitigation discount and an 11 month discount for a late guilty plea, and therefore imposed a concurrent custodial sentence of five years and seven months; prior appeal and resultant parole timing did not justify further reduction given statutory and case law framework.
