Leave to adduce the affidavits was declined because Mr Denton's affidavit was unnecessary and of limited utility given disputes about its calculations, and Mr Lazelle's affidavit largely replicated material already before the Court and addressed issues that had been squarely before the Court at the original hearing; admitting further explanation at this late stage was not in the interests of justice.
