Rule 7.70 of the District Court Rules applies to statutory liens including those under s 23 of the Carriage of Goods Act 1979; the court may order payment into court inclusive of amounts on account of costs, interest and storage; applying that discretion the respondent was ordered to pay a total of NZD 14,000 into court (inclusive of NZD 4,617.82 already paid) unless the respondent elects to have the NZD 9,304.50 costs award stayed pending final resolution.
