The application is dismissed because the Court is not satisfied a Judge has jurisdiction to review the Registrar's decision and, on the assumption jurisdiction exists, the Registrar did not err: the lodged documents did not constitute an application or appeal under the Court of Appeal (Civil) Rules 2005, and the Registrar lacks power to amend the Court's formal 8 October 2003 decision.

Cooper J's direction was administrative guidance about the appropriate High Court registry and was not a judgment, decree or order within s 66 of the Judicature Act 1908; therefore it was not appealable and the Registrar correctly refused to accept the purported notice of appeal, so the application for review is dismissed and the Registrar's decision is upheld.

The Registrar lawfully considered the written fee agreement but was entitled to place it to one side after assessing all circumstances; there was an evidential basis for concluding $3000 was a fair and reasonable fee for the appeal work and the Registrar's decision was not plainly wrong, so the High Court confirms the Registrar's decision and grants an extension of time to permit review proceedings to be filed.
