The appeal is dismissed because the appellant, having succeeded on the primary ground in the High Court, had no right to appeal collateral adverse findings of fraud that did not affect the outcome; those findings do not bind the parties in the subsequent common law enforcement proceeding and the fraud issue was inadequately pleaded and evidenced to be determined on the interlocutory record.
