The Court granted the without‑notice originating application and extinguished the registered riparian easements because evidence established the easements had become redundant, there had been a change in the nature and extent of use and of the neighbourhood since their 1907 creation, their continuation would impede reasonable use of the burdened land, and extinguishment would not substantially injure any person entitled to benefit; the District Council did not oppose extinguishment.
